Terms of Service

1. Agreement

These Terms govern access to and use of the Simon Eyes product ("Service") provided by 3R Innovation Inc. ("3R Innovation," "we," "us"). By using the Service, an institution and its authorized users agree to these Terms and to any separate order form or institutional agreement that has been signed.

2. Who can use the Service

Simon Eyes is licensed to schools, universities, testing bodies, and other educational institutions ("Institutions"). Individual students, teachers, and proctors access the Service as authorized users of an Institution's account, subject to that Institution's own policies.

3. What the Service does — and does not do

• Simon Eyes observes assessment-relevant behavioral signals and produces evidence summaries for a human reviewer (a teacher or proctor) to examine.
• Simon Eyes does not make a final determination that a student has violated academic integrity rules. That decision is always made by a person at the Institution.
• Accuracy figures shown on our marketing site reflect internal benchmark testing under specific conditions; results in a given classroom or exam setting may vary, and full methodology is available to Institutions on request.

4. Institution responsibilities

The Institution is responsible for obtaining any consents required by applicable law (including parental/guardian consent for minors where required), for configuring the product appropriately for its use case, and for how it acts on the evidence the product provides — including any appeal or review process offered to students.

5. Acceptable use

Users may not attempt to circumvent, disable, or reverse-engineer the Service; use it to violate any applicable law; or use it in a way that discriminates against or unfairly targets any student or group of students.

6. Intellectual property

3R Innovation retains all rights in the Service, including its software, models, and documentation. Institutions retain ownership of the data they submit and generate through use of the Service, subject to our Privacy Policy.

7. Confidentiality and data protection

Each party will handle the other's confidential information consistent with the terms of any signed institutional agreement and our Privacy Policy.

8. Warranties and disclaimers

The Service is provided "as is." To the maximum extent permitted by law, 3R Innovation disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Limitation of liability

To the maximum extent permitted by law, 3R Innovation's aggregate liability arising from use of the Service will be limited as set out in the applicable institutional agreement, or otherwise to the amount paid for the Service in the twelve months preceding the claim.

10. Changes

We may update these Terms from time to time. Material changes will be communicated to Institutions in advance of taking effect.

11. Governing law

These Terms are governed by the laws specified in the applicable institutional agreement; absent such an agreement, by the laws of the Republic of Korea, without regard to conflict-of-law rules.
